4.1 Illegal Activities

• Using the Bot for any illegal purposes under local, national, or international law
• Promoting or facilitating illegal gambling, money laundering, or fraudulent activities
• Distributing malware, viruses, or harmful code
• Engaging in harassment, hate speech, or discriminatory behavior

4.2 Platform Abuse

• Attempting to circumvent rate limits or usage restrictions
• Creating multiple accounts to participate in giveaways multiple times
• Using automated tools or bots to interact with our Bot
• Reverse engineering, decompiling, or attempting to extract source code
• Interfering with the Bot's normal operation or other users' access

4.3 Content Violations

• Hosting giveaways for illegal, harmful, or inappropriate content
• Using the Bot to distribute copyrighted material without permission
• Creating giveaways that violate Discord's Terms of Service
• Posting content that is offensive, defamatory, or violates others' rights

5.1 Giveaway Creation

• Server administrators are responsible for the legitimacy of their giveaways
• Giveaway creators must have the legal right to offer the advertised prizes
• All giveaways must comply with applicable local and international laws
• Prize descriptions must be accurate and not misleading

5.2 Participation

• Participation in giveaways is voluntary and at your own risk
• Users may be required to meet specific criteria (voice activity, server membership, etc.)
• The Bot does not guarantee fairness beyond its programmed algorithms
• Winners are selected randomly by the Bot's automated systems

5.3 Prize Distribution

• We are not responsible for prize fulfillment or delivery
• Prize distribution is the sole responsibility of the giveaway creator
• Disputes regarding prizes must be resolved between participants and giveaway creators
• We do not verify the authenticity or value of prizes offered

6.1 Data We Collect

The Bot may collect and store:

• Discord user IDs and server IDs
• Giveaway participation data
• Voice activity statistics
• Server configuration settings
• Command usage statistics
• Error logs and diagnostic information

6.2 Data Usage

We use collected data to:

• Comply with legal obligations

6.3 Data Protection

• Data is stored securely with automatic cleanup after 2 years
• We do not sell personal data to third parties
• You may request data deletion by contacting our support team

6.4 Data Retention

• Giveaway data is automatically deleted 2 years after completion
• User statistics may be retained for analytical purposes
• Server settings are maintained while the Bot remains in the server
• Logs and diagnostic data are retained for up to 90 days

7.1 Service Availability

• The Bot is provided "as is" without guarantees of uptime or availability
• We may suspend or discontinue the service at any time with or without notice
• Scheduled maintenance may temporarily interrupt service
• We are not liable for any damages resulting from service interruptions

7.2 Usage Limitations

• Rate limits may apply to prevent abuse and ensure fair usage
• Certain features may be restricted based on server size or activity
• We reserve the right to limit or suspend access for policy violations
• Advanced features may require specific permissions or configurations

7.3 Technical Requirements

• The Bot requires specific Discord permissions to function properly
• Users must maintain compatible Discord client versions
• Network connectivity and Discord's availability affect Bot functionality
• Some features may not be available in all regions

8.1 Our Rights

• The Bot, its code, design, and functionality are our intellectual property
• Our trademarks, logos, and branding are protected by applicable laws
• You are granted a limited, non-exclusive license to use the Bot as intended
• This license may be revoked at any time for policy violations

8.2 User Content

• You retain ownership of content you create using the Bot
• You grant us a limited license to process and display your content as necessary
• You are responsible for ensuring you have rights to any content you use
• We may remove content that violates these Terms or applicable laws

8.3 Third-Party Content

• We are not responsible for third-party intellectual property violations

9.1 Service Disclaimers

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uninterrupted, timely, secure, or error-free operation
• Accuracy, reliability, or completeness of any information or content
• Compatibility with your systems, software, or hardware

• The Bot does not provide legal, financial, or professional advice
• Any information provided is for general informational purposes only
• Users should consult appropriate professionals for specific advice
• We disclaim all liability for decisions made based on Bot-provided information

9.3 Third-Party Services

• We are not responsible for the availability or content of third-party services
• Links to external websites or services do not constitute endorsements
• Users interact with third-party services at their own risk
• Third-party terms and privacy policies may apply

10.1 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers
• Damages resulting from service interruptions or delays
• Any damages arising from your use or inability to use the Bot

10.2 Maximum Liability

Our total liability for any claims arising from or related to the Bot shall not exceed the amount you paid us (if any) for using the Bot in the 12 months preceding the claim.

10.3 Essential Purpose

These limitations are fundamental elements of the basis of the bargain between you and us. The Bot would not be provided without such limitations.

12.1 Termination by You

• You may stop using the Bot at any time
• Remove the Bot from your server to terminate service for that server
• Contact us to request data deletion after termination

12.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for:

• Violations of these Terms of Service
• Requests by law enforcement or other government agencies
• Unexpected technical or security issues
• Discontinuation of the service (with reasonable notice when possible)

12.3 Effect of Termination

Upon termination:

• Your right to use the Bot ceases immediately
• We may delete your data in accordance with our retention policies
• Provisions that by their nature should survive termination will remain in effect
• You remain liable for any obligations incurred prior to termination

13.1 Informal Resolution

Before filing any formal dispute, you agree to try to resolve the dispute informally by contacting our support team. We will attempt to resolve the dispute through good faith negotiations.

13.2 Binding Arbitration

If informal resolution fails, any dispute arising from or relating to these Terms or the Bot will be resolved through binding arbitration rather than in court, except for disputes that may be brought in small claims court.

13.3 Class Action Waiver

You agree that any arbitration will be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify users through the Bot or other reasonable means when material changes are made
• Provide a reasonable period for you to review the changes

15.2 Acceptance of Changes

Your continued use of the Bot after any modification to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Bot.

15.3 Material Changes

For material changes that affect your rights or obligations, we will provide at least 30 days' notice before the changes take effect.

16.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Bot and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

16.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, elements of nature, acts of God, wars, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.
